Wimble Square is a townhouse community in Wilmington, NC, governed by a homeowners association (HOA). Each owner owns a lot and a single-family townhouse dwelling, and shares ownership of common areas. The rules bind all lot owners and are enforced by the Wimble Square Homeowners Association.
- What you own & maintain: You own your lot and the townhouse on it. You are responsible for maintaining your lot and improvements. The association may step in to maintain trees, shrubs, grass, and walkways if needed, and can charge you for it.
- Architectural review: No building, fence, wall, or exterior alteration may be started without written approval from the Board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Party walls: Walls on lot dividing lines are party walls. Repair costs are shared by owners who use the wall in proportion to use. Disputes go to arbitration.
- Assessments & fees: Annual assessments fund common area maintenance, recreation, health, safety, and liability insurance. Maximum annual assessment started at $180 per lot and can increase up to 5% per year without a vote; higher increases need 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 vote. Assessments are a lien on the lot and a personal obligation of the owner.
- Use restrictions: Lots are for residential use only. Only one single-family townhouse dwelling per lot, max three stories. No temporary structures, trailers, tents, or outbuildings used as residences. No noxious or offensive activities.
- Parking: Each lot is entitled to one assigned parking space, as near and convenient as possible, with ingress/egress rights.
- Insurance: The association must carry liability insurance covering common property and its own negligence. Cost is covered by assessments.
- Enforcement & amendment: The association or any owner can enforce the covenants. Amendments in the first 20 years require 90% of lot owners; after that, 75%. Covenants automatically renew every 10 years after the initial 20-year term.
