Wrightsville West Townhouses is a townhome community in Wilmington, NC, where you own a lot and a townhouse unit, and share ownership of common areas through the homeowners association (Wrightsville West, Inc.). The association maintains common areas and provides exterior maintenance for each unit, funded by assessments. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all owners, tenants, and occupants.
- What you own & maintain: You own your lot and townhouse unit. The association maintains common areas and provides exterior maintenance for each unit (roofs, gutters, exterior surfaces, decks, landscaping, walks), but not glass surfaces. If damage is caused by your negligence, the repair cost is added to your assessment.
- Assessments & fees: Annual assessments are levied per lot, initially capped at $1,000 per year (1983), with annual increases up to 5% without a vote. Special assessments for capital improvements require a 2/3 vote of each membership class. A working capital assessment equal to two months' estimated assessment is due at closing. Unpaid assessments bear 10% annual interest and become a lien on the property.
- Leasing & rentals: Leases must be consistent with the declaration and association rules. The board may recommend rental agents but cannot control rental periods or commissions. Owners have the right to rent directly. No rental pooling or requirement to rent is created.
- Pets: Dogs, cats, or other household pets are allowed, but not for commercial purposes. Pets must be leashed and personally escorted at all times; they cannot run free.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Parking & vehicles: Inoperable vehicles without current registration and insurance are prohibited and may be towed at owner's expense. - Use restrictions: All lots are for residential use only (except Lot 1 may be a sales/rental office). No temporary structures, outside antennas (without permission), or 'For Sale' signs (except on Lot 1). Window coverings must include mini-blinds as permanent fixtures; exterior lights must be clear/white/non-frost. No furniture on front porches except porch furniture and plants; grills must be stored when not in use.
