The Gates at Landfall is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This declaration applies to all lots and binds owners, tenants, and occupants. It supplements the master Landfall Subdivision I restrictions, which take precedence in case of conflict.
- What you own & maintain: You own your lot and dwelling. The association maintains landscaping on each lot, the storm drainage system, and irrigation equipment, and may enter your lot for that purpose. You are responsible for sewer service charges and for keeping your lot free of weeds, underbrush, and refuse.
- Architectural review: No structure, exterior change, or painting may begin without written approval from the Declarant (or later the Board/committee). Plans are reviewed for harmony of design and location. Approval is deemed given if no response within 30 days. Minimum enclosed dwelling area is 1,500 square feet (excluding garages, decks, porches). No dwelling may be closer than 20 feet to any other dwelling on an adjoining lot.
- Use restrictions: Lots are for single-family residential use only. No noxious or offensive activities, no temporary structures as residences, no boats, campers, trailers, or mobile homes without consent. No inoperable or unregistered vehicles, no tractor-trailers. No TV satellite dishes; outside antennas require permission. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or non-frost. No signs except permitted real estate signs. No subdividing without consent.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and not allowed to run free. No livestock or poultry.
- Assessments & fees: Annual assessments are set by the Board and may increase up to 5% per year without a membership vote. The initial maximum was $400 per lot. Special assessments for capital improvements require a 2/3 vote of members. Insurance assessments are additional. Assessments are a lien on the property and a personal obligation of the owner. Unpaid assessments bear interest and may be foreclosed.
- Leasing & rentals: The document does not restrict leasing terms or require HOA approval for leases. However, all tenants must comply with the declaration and the master LSI restrictions.
