What Cross Point Plaza Condominium's governing documents say
Cross Point Plaza Condominium is a commercial condominium in Wilmington, NC — you own your unit (restricted to retail and office use) and share ownership of the building's common elements. The association maintains common areas and carries master insurance, funded by assessments based on unit square footage. This declaration governs unit owners, not residential tenants.
- What you own & maintain: You own the interior of your unit (within finished surfaces of walls, floors, and ceilings) and must maintain it at your own expense. The association maintains all common elements, including structural columns, exterior doors/windows, and limited common elements like stoops and HVAC units serving your unit.
- Permitted uses: Units are restricted to retail and office use and any other commercial activity allowed by zoning. Prohibited uses include health clubs, dance/karate studios, skating rinks, bowling alleys, and establishments selling alcohol for on-premises consumption. No residential use is allowed.
- Leasing & rentals: Units may be leased subject to association rules. Leases must include a provision that tenants recognize the association as landlord for enforcement purposes. Timesharing is prohibited.
- Architectural review: No structural additions, alterations, or improvements may be made without prior written consent of the executive board. Exterior painting, marking, or decorating also requires board approval.
- Parking & vehicles: Parking areas may be allocated as limited common elements to specific units. Designated parking areas may only be used for vehicular parking; no outside storage is permitted. Operative and licensed vehicles used in a trade or business may park overnight in unallocated spaces.
- Assessments & voting: Common expense liability is based on unit square footage. Each unit has one equal vote. The association may establish reserves for repairs and replacements.
- Hazardous substances & environmental compliance: Unit owners must not use, generate, store, or dispose of hazardous substances on the property, and must indemnify the association for any related costs. Owners must promptly report any environmental proceedings or conditions.
