Rose Bank is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land and binds all current and future owners. The rules focus on residential use, architectural standards, and property maintenance, with no homeowners' association or common assessments.
- What you own & maintain: You own your lot and detached single-family home. You must maintain the property in a neat and tidy condition, keep drainage ditches clear, and clear debris within 90 days after fire or casualty.
- Architectural review: All building designs (including dwellings, garages, storage buildings, and additions) must be approved by the Developer (or its agent) within 10 days of a written request. If no response, approval is not required, but the design must harmonize with existing structures.
- Building materials & appearance: Dwellings must be wood, brick, brick veneer, concrete block with brick veneer, vinyl siding, composition board, or other approved synthetic material. Detached structures must match the main dwelling's materials, color, and general appearance.
- Fences: A 5-foot easement exists along side property lines for a common fence. All fences must be the same design, height, type, and general appearance as the first fence built in the subdivision. Maintenance is shared equally between adjoining owners.
- Pets: Only household pets are allowed, and they may not be kept for commercial purposes. Pets must be kept inside, in an approved fenced area, or on a leash.
- Parking & vehicles: No more than three motor vehicles per home, all in good running order. No more than two cars may be parked in the driveway; the third must be in the garage. Boats, RVs, motorcycles, and semi-trucks must be parked in the back yard. No mechanical work in front or side yards or streets.
- Leasing & rentals: Rentals are allowed, but the owner must inform tenants of these restrictions and is responsible for tenant compliance. The restrictions apply to both owners and tenants.
- Signs & window treatments: Only 'For Sale' or 'For Rent' signs up to 5 square feet are allowed. Permanent window treatments must be installed within 30 days of occupancy; bedsheets and towels are not acceptable. Satellite dishes must not be visible from the street. Clotheslines must be screened from public view.
