What Pond Crossing's governing documents say
Pond Crossing is a single-family home subdivision in Wilmington, NC. These protective covenants run with the land and bind all lot owners, setting rules for land use, building size and design, and property maintenance to preserve the neighborhood's character.
- Land use & building type: Lots may be used only for single-family residential purposes. Only one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building (max 250 sq ft, located behind the dwelling) are allowed.
- Dwelling size: Every home must have at least 1,050 square feet of living area, not counting porches, breezeways, steps, or garages.
- Architectural review: Building plans, specifications, and a plot plan must be submitted to the Declarant (or its successors) for approval of design, harmony, and location. If no response within 30 days, approval is deemed given.
- Setbacks & lot adjustments: Setbacks follow New Hanover County's performance residential subdivision standards. Lot lines may be adjusted between two lots as long as no lot loses more than 10% of its area and all other restrictions are met.
- Business & nuisance prohibitions: No business, manufacturing, commercial, or professional use is allowed. No noxious or offensive activity, no signs (except real estate signs), and no storage of trade materials or inventory on lots.
- Animals: Only house pets are permitted; no other animals or poultry may be kept.
- Parking & vehicles: Each lot must provide adequate off-street parking. Street parking is not allowed. Boats, trailers, campers, and similar items must be parked in a garage or screened area. Unlicensed or junk vehicles are prohibited.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are allowed only behind the dwelling and must be approved by the Declarant. Mailboxes require prior approval of design and location to ensure uniformity; if no response within 60 days, approval is assumed.
