What Marathon Colony's governing documents say
Marathon Colony is a single-family residential subdivision in Wilmington, NC, governed by a 1977 Declaration of Restrictions. These rules apply to all lot owners and are designed to maintain the community's residential character.
- Residential use only: All lots must be used for single-family residential purposes only. No commercial business enterprise may be conducted from any residence, lot, or other portion of the property.
- Setback requirements: No part of any building may be closer than 75 feet to any lot boundary line. If an owner combines two or more lots for one residence, the interior boundary lines are not considered side boundaries.
- Prohibited structures: No house, trailer, mobile home, tent, shack, or temporary structure may be placed on a lot or used as a residence, either temporarily or permanently.
- Architectural review (expired): Before January 1, 2000, all building plans required approval from Charles Edward Crowell or his heirs/assigns. This approval requirement has now expired.
- Lot subdivision restrictions: Lots sold by the original developers may not be re-subdivided unless the subdivided part becomes part of an adjacent lot.
- Utility wires: All utility wires on any lot must be buried underground.
- What this document doesn't cover: This document does not address assessments, an HOA board, common areas, leasing restrictions, pet limits, parking rules, or any enforcement mechanism beyond court action.
