Tall Tree is a single-family home HOA in Wilmington, NC. This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that apply to all lots in Section 1. It establishes the homeowners association, sets use restrictions, and governs architectural control, assessments, and easements.
- What you own & maintain: You own your lot and the single-family home on it. The association maintains the common areas, including private roads, streets, and drainage easements. You must maintain your own lot and driveway culvert.
- Use restrictions: Lots are for single-family residential use only. No business, trade, or occupation is allowed. Temporary structures like trailers or tents are prohibited unless screened from view. No noxious or offensive activities are permitted.
- Pets: Only domesticated pet dogs, cats, and birds are allowed. No other animals may be kept on any lot.
- Signs: Only a temporary 'For Sale' sign (max 6 sq ft) and a property identification sign (max 2 sq ft) are allowed.
- Architectural review: No structure, fence, wall, or other improvement may be built or altered without prior written approval from the Declarant (or its assignee). Approval may be based on any ground, including aesthetics. Minimum dwelling size is 1,800 sq ft of enclosed area (excluding garages, porches, etc.). Maximum height is 2.5 stories. Minimum front setback is 65 feet from Tall Tree Lane; side setbacks are 20 feet. No fence may be located nearer the front lot line than the rear corners of the house.
- Parking & vehicles: Each lot must provide off-street parking for at least three cars. Driveways and parking areas must be constructed of asphalt, crushed stone, or approved material.
- Assessments & fees: Annual assessments are levied per lot. The initial maximum annual assessment was $120 per lot (as of 1981), with annual increases capped at 3% without a membership vote. Special assessments for capital improvements require a two-thirds vote. Assessments are a lien on the lot and a personal obligation of the owner.
