Pine Cliff is a single-family home subdivision in Wilmington, NC, governed by a 1976 declaration of covenants and restrictions that run with the land. These rules apply to all lot owners in Section A and are designed to maintain a residential character with minimum construction standards.
- Residential use & structures: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to 3 cars are allowed. No trailers, tents, shacks, or outbuildings may be used as residences.
- Setbacks & lot subdivision: Buildings must be at least 50 feet from the front street line and 10 feet from adjacent property lines. Lots cannot be re-subdivided unless the subdivided part becomes part of another lot.
- Exterior materials & design approval: Exterior siding cannot be frame asbestos, cement blocks, cinder blocks, imitation brick, or stone siding. Building design must be approved by the developer or a committee; if no response within 10 days, approval is not required as long as the design is in harmony with existing structures.
- Minimum floor area: Each dwelling must have at least 1,600 square feet of interior floor area.
- Construction timeline: Once construction begins, the exterior must be finished within one year from the date the foundation is laid.
- Duration & amendment: The covenants run with the land until January 1, 2001, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
- Sewage disposal: Until municipal sewage is available, sewage disposal must meet the approval of the N.C. State Board of Health.
