Friendly Oaks is a small, single-family-home subdivision in Wilmington, NC, with just four lots. There is no homeowners association or regular dues. The rules are enforced by lot owners themselves and by the developer (Declarant) until control is turned over. The covenants focus on preserving the oak trees, maintaining an upscale residential character, and giving an Architectural Control Agent broad authority over design and landscaping.
- Lot use & minimum house size: Lots are for residential use only. No business, manufacturing, or commercial activity. No mobile homes or prefabricated manufactured housing. Houses must have at least 2,200 heated square feet and decorative features on the front elevation.
- Architectural review: All building design and landscaping plans must be approved by the Architectural Control Agent (initially Beach Haven, LLC). The agent has 10 business days to approve or disapprove; if no response, approval is not required, but the design must still harmonize with existing structures. Preservation of oak trees is a dominant factor in approvals.
- Pets & animals: No more than 4 household pets per lot. Pets must be leashed or confined in a fenced area. Owners must clean up pet waste. Additionally, up to 6 rabbits and 6 laying hens (no roosters) are allowed in an enclosed pen behind the main residence, provided they don't create a nuisance.
- Parking & vehicles: All vehicles must be parked in driveways, not on lawns or roadways. No inoperable vehicles, vehicles without current registration/inspection/license/insurance, or tractor-trailers. No open storage of boats, RVs, campers, or trailers in front or side yards; if kept in back yards, they must be screened from view. Vehicle repairs in driveways must be completed in one day.
- Yard maintenance & appearance: Lots must be kept neat and tidy, mowed, fertilized, and watered. No statues, yard decorations, artificial wildlife, or similar objects. No trees larger than 4 inches in diameter may be cut without written permission. No treehouses in front or side yards (one swing allowed). Trash receptacles, lawn furniture, toys, and similar items must be stored out of view from the street.
- Fences & window coverings: Fences require Architectural Control Agent approval; chain link, split rail, and welded wire are prohibited. White window treatments must be installed in all windows within 10 days of occupancy, visible from the outside. Bed sheets, towels, and blankets are not acceptable.
- Signs & mailboxes: Only one 18" x 24" 'For Sale' sign per lot (by builder or realty agent) is allowed. No other signs. Each lot must have one mailbox, with design subject to Architectural Control Agent approval.
- Dues & assessments: There are no regular dues or assessments. Each lot owner is individually responsible for maintaining casualty and liability insurance on their lot and exterior.
