Waterview is a 27-unit condominium community in Carolina Beach, NC. You own your unit and an equal 3.7037% share of the common elements. The association maintains the building's structure and common areas, carries master insurance, and levies assessments. This declaration governs all owners, tenants, and guests.
- What you own & maintain: You own the interior of your unit from the unfinished perimeter walls, floors, and ceilings inward, including interior surfaces, fixtures, and appliances. You must maintain and repair all interior portions. The association maintains the common elements (e.g., retention pond, pool if built) and limited common elements (e.g., decks serving only your unit).
- Leasing & rentals: Units may be rented for residential purposes, including vacation rentals, but no lease may be for less than the whole unit. Subdividing a unit or renting individual rooms is prohibited.
- Pets: Only domestic household pets are allowed, subject to association rules that may regulate or prohibit the kind and number. Pets must be leashed outside, waste must be removed immediately, and excessive noise is prohibited. No commercial breeding or keeping of animals.
- Parking & vehicles: No campers, trailers, boats, or similar vehicles may be parked on the property. Only standard pickup trucks or smaller trucks are allowed. No wrecked, junk, or unregistered vehicles. Parking is only in marked spaces; the association may assign or reassign spaces.
- Architectural review: No structural modifications, exterior changes (including painting, satellite dishes, signs), or alterations to common elements are allowed without prior written consent of 90% of all unit owners. Window coverings must appear white from the exterior unless approved by 90% of owners.
- Assessments & fees: Initial monthly dues are $247 per unit (equal for all units). A working capital assessment equal to two months' regular assessment plus a prorata share of the first year's insurance premium is due at closing. Late fees (4% of amount due) and interest (10% per annum) apply to delinquent assessments. Unpaid assessments create a lien enforceable by foreclosure.
- Use restrictions & conduct: Units are for residential use only. No activity that annoys residents or interferes with peaceful enjoyment is allowed. No burning of wood or trash, no hanging laundry outside, no storage of trash containers on balconies, and no recreational use of the retention pond. Grills may not be used on balconies or screened porches.
- Timesharing: Timesharing is permitted, with up to 12 shares per unit, subject to North Carolina timeshare laws.
