Ocean Heights is a planned community (single-family homes) in Carolina Beach, NC, governed by a homeowners association (HOA). This document establishes the HOA, defines property rights, and sets rules for assessments, common areas, and annexation. It applies to all lot owners in the community.
- Membership & voting: Every lot owner is a member of the HOA. There are two voting classes: Class A (all owners except the developer) gets one vote per lot; Class B (the developer) gets three votes per lot until Class A votes equal Class B votes or 10 years after the association is formed, whichever comes first.
- Assessments & fees: The HOA can levy annual and special assessments. The maximum annual assessment for 2007 was $1,800 per lot. The board can increase it up to 10% per year without member approval; larger increases require a 2/3 vote of members. Special assessments for capital improvements need 67% member approval. Assessments are a lien on the lot and a personal obligation of the owner.
- Common area use & restrictions: All owners have an easement to use common areas (e.g., drives, walkways, parking, recreational facilities). The HOA can charge fees for facility use, suspend voting/use rights for unpaid assessments (until paid) or rule violations (up to 60 days), and impose rules. Owners may delegate use to family, tenants, or contract purchasers who reside on the lot.
- Annexation & development rights: Additional land can be added to the community only with a 2/3 vote of each membership class. The developer reserves rights to add land, create lots, modify lot types, and withdraw undeveloped property.
