Olde Mariner's Village is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and guests. It covers property rights, assessments, use restrictions, architectural control, and stormwater management.
- What you own & maintain: You own your lot and the single-family home on it. The HOA owns and maintains common areas, including the stormwater pond tract, private roads, and drainage facilities. You must maintain your lawn and landscaping per approved plans.
- Assessments & fees: Annual assessments are set by the board (initial dues $50/year). A one-time working capital assessment of $100 is due at purchase from the developer. Special assessments for capital improvements require a two-thirds vote of members. Unpaid assessments accrue interest and can become a lien on your lot.
- Architectural review: All exterior changes—including house plans, fences, driveways, and landscaping—must be approved by the Declarant (developer) or, after developer control ends, by an elected Architectural Review Committee. Minimum heated square footage for a house is 1,100 sq ft. Fences cannot extend past the front corners of the house, and chain-link fences visible from the street are prohibited.
- Leasing & rentals: No lot may be leased for less than six months. Short-term rentals are not allowed.
- Pets & animals: Only domestic dogs, cats, or other household pets are allowed. No animals, livestock, or poultry are permitted. Pets cannot be kept for commercial purposes or in numbers that create a nuisance.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, with driveways made of concrete, asphalt, brick, or approved material. Boats, recreational vehicles, and inoperable vehicles cannot be parked on streets, common areas, or rights-of-way. No mechanical work on vehicles in front or side yards or on the street.
- Stormwater & drainage: The HOA is responsible for maintaining stormwater facilities. No more than 3,000 sq ft of impervious surface per lot is allowed without a state permit modification. Swales cannot be filled or piped except for driveway crossings. Fencing is prohibited in drainage and access easements.
- Use restrictions: Lots are for single-family residential use only. No temporary structures, modular homes, or mobile homes. No noxious activities, junk vehicles, or signs without board permission. Satellite dishes under 18 inches not visible from the street are allowed. Exterior lights must be clear, white, non-frost, or yellow bug bulbs.
