Ocean Tides Townhomes is a planned community of townhomes in Carolina Beach, NC, governed by a homeowners association (HOA). The rules apply to all lot owners, residents, tenants, and guests. This document establishes the HOA's authority, use restrictions, and maintenance obligations for the community.
- What you own & maintain: You own your townhome lot (land and building). The association owns and maintains common elements (streets, sidewalks, open space, amenities). You must maintain your own unit and any utility lines serving only your home. Party walls between units are shared maintenance costs.
- Residential use only: All lots are restricted to single-family residential use. No nursing homes, group homes, or similar institutions are allowed. Home offices are permitted only if no customers or clients visit and the board approves in writing.
- Leasing & rentals: Leases must be for at least six months. Short-term rentals and time-sharing are prohibited. The board may adopt additional rules on rentals.
- Pets: Only ordinary household pets are allowed, with number and type subject to board rules. Pets must be leashed outside the lot, and owners must clean up waste. No commercial breeding.
- Architectural review: No permanent structures or structural alterations may be built without written board approval. The board may adopt architectural standards. Lots cannot be subdivided.
- Parking & vehicles: No motor vehicles, ATVs, or golf carts are allowed in pedestrian access easements. The board may adopt parking rules. No obstruction of driveways or sidewalks.
- Assessments & fees: All lot owners must pay annual and special assessments for common expenses. Unpaid assessments become a lien on the lot and a personal obligation of the owner. The declarant is exempt from assessments on unoccupied lots.
- Insurance: Owners must insure their units for 100% replacement cost and provide proof to the board. The association carries blanket property and liability insurance on common elements, with at least $1 million per occurrence.
