Island Palms Subdivision is a standard single-family HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners, residents, and their guests. It establishes the homeowners' association, sets rules for property use, and creates a lien-based assessment system.
- What you own & maintain: You own your lot and the dwelling on it. You must maintain your lot (including structures) in clean, attractive condition and repair damage within 90 days. The association maintains common areas (private roads, stormwater ponds, etc.) funded by assessments.
- Architectural review: All exterior improvements or modifications require prior approval from the Architectural Control Committee (appointed by the developer initially, later by the association). The committee can deny based on aesthetics. Approval expires if construction doesn't start within 6 months or finish within 1 year.
- Leasing & rentals: Leases must be for at least three consecutive months. No short-term rentals under 3 months are allowed.
- Parking & vehicles: Only standard passenger vehicles, passenger vans, and pick-up trucks with current plates and in operating condition may be parked. Boats and RVs must be on driveways or pads. Inoperable vehicles may be towed. No vehicle repairs visible from the street.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and under control at all times, and owners must immediately clean up waste. No livestock or poultry.
- Assessments & fees: Each lot owner must pay annual assessments, plus possible special, insurance, ad valorem tax, and working capital assessments. The first annual assessment is set by the developer. Unpaid assessments become a lien on the lot after 30 days, with interest and attorney's fees. The developer does not pay assessments on lots it owns.
- Use restrictions: Lots are for residential use only—one single-family home (minimum 1,200 sq ft) or duplex (minimum 800 sq ft per unit). No mobile homes, temporary structures as residences, or commercial activities. No yard statuary or satellite dishes over 18 inches visible from the street. Christmas decorations only Nov 20–Jan 7. Trash cans must be hidden except on pickup days and removed within 8 hours.
