What Green Acres's governing documents say
This document is a collection of multiple, separate sets of restrictive covenants for different subdivisions all named 'Green Acres' in different counties (New Hanover, Laurens, Buncombe) in North Carolina and South Carolina. The first set (1961, New Hanover County) is a standard single-family subdivision covenant. The second set (1967, Laurens County, SC) is also a standard single-family subdivision covenant. The third and fourth documents (2025, Buncombe County, NC) are addenda to a restated declaration for a specific subdivision, dealing with lot mergers and developer rights. Because these are unrelated documents from different communities, a single unified guide is not possible. The following summary covers only the first complete set of covenants (1961, New Hanover County, NC) as a representative example.
- Land use & building type: Lots may be used only for residential purposes. Only one detached single-family dwelling, not exceeding two stories, plus a private garage for no more than two cars, is allowed. No garage apartments or outbuildings used as residences.
- Minimum dwelling size & quality: Each dwelling must cost at least $8,000 and contain at least 1,050 square feet of living area. Exterior finish must be brick or stone, except for roofs, windows, doors, and gables.
- Setbacks: No building may be located nearer than 8 feet to any side lot line, nor nearer than 40 feet from the eastern right-of-way line of Rose Avenue.
- Prohibited uses & nuisances: No commercial, noxious, or nuisance activity is allowed. No temporary structures, trailers, mobile homes, tents, or shacks may be used as residences. No livestock (hogs, cattle, sheep, goats, horses, poultry) may be kept; dogs, cats, and other household pets are allowed but not for commercial purposes.
- Waste & sanitation: No dumping of rubbish or garbage; waste must be kept in sanitary containers. No surface closets or outhouses; sewage disposal must be by septic tank meeting state health board requirements until a public system is installed.
- Lot subdivision: No lot may be subdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Term & enforcement: Covenants run with the land for 10 years from February 13, 1961, automatically renewing for successive 10-year periods unless a majority of lot owners record a change. Any lot owner may enforce the covenants through legal proceedings.
