This document is an amendment to the Declaration of Restrictive Covenants for the Olde Point Development, a single-family home subdivision in Hampstead, North Carolina. It governs properties in Phases I and II and is binding on lot owners. The community's governing document sets rules for land use, construction, appearance, and membership in the property owners association.
- Single-family residential use: All lots are for single-family homes only; no business, manufacturing, or temporary structures (like tents or trailers) are allowed. One home per lot.
- Building and size standards: New homes must be at least 1,800 sq. ft. (one-story) or 2,250 sq. ft. (two-story, with at least 1,500 sq. ft. on the first floor). Maximum height is 35 feet from front ground level. No manufactured homes.
- Architectural review: All building plans, fences, and exterior changes must be approved in writing by the Architectural Control Committee (ACC) before construction or alteration begins.
- Setbacks and lot improvements: No building within 15 feet of an adjacent lot. The ACC controls final location and may allow up to 10% (1.5 ft.) variation. Trees over 6 inches in diameter cannot be removed within setback areas without ACC approval.
- Construction timeline: Exterior work must be completed within 12 months of plan approval. If construction hasn't started within that time, plans must be resubmitted.
- Fences: Fences require ACC approval and are generally discouraged except for pool safety. Allowed materials: wood, iron, or aluminum with at least 3 inches between vertical rails. Height: 4–5 feet. No chain-link, wire, privacy, or front-yard fences. Must be at least 3 feet from property lines and 50 feet from golf course boundaries.
- Parking and vehicles: At least two off-street parking spaces required per home. Commercial vehicles larger than standard pickup trucks/vans must be garaged or screened. Boats may be parked behind or beside the home but not curbside. Recreational vehicles and trailers are not allowed to park on lots except for brief loading or guest visits.
- Pets and animals: No livestock. Dogs and cats allowed as household pets only (not for commercial purposes). Must be controlled on owner's property or leashed off-property. Owners must clean up litter on others' property. Pens must be unobtrusive from the road.
