McClelland Woods is a single-family home subdivision in Wilmington, NC, governed by a declaration of covenants that runs with the land. These rules apply to all lot owners and their successors, and are designed to protect property values and maintain a uniform residential character.
- Permitted uses & homes: Each lot must be used for residential purposes only, with one detached dwelling and one detached double garage per lot, following a representative plot plan. No variation from the plan is allowed without written approval from the Declarant and a majority of lot owners.
- Architectural control: No building, fence, wall, or other structure may be erected or altered, and no lot grade or physical characteristic may be changed, unless according to plans delivered by Declarant. Any deviation requires Declarant's written approval, which shall not be unreasonably withheld and must be given within two weeks of submission.
- Temporary residences & subdivisions: No housetrailer, mobile home, tent, shack, or temporary structure may be used as a residence. Residential building lots may not be resubdivided.
- Signs: Only one 'For Rent' or 'For Sale' sign per lot is allowed, maximum five square feet, plus private name plates or resident identification signs. No other signs or billboards are permitted.
- Pets & animals: No domesticated farm animals or fowls are allowed; only non-violent domesticated household pets are permitted. Pets must be leashed and escorted when not secured on the owner's lot by chain.
- Vehicles & parking: Inoperative junk cars, large trucks, buses, and recreational vehicles (including boats, motor homes, and trailers) may not be stored on the property. Common driveways may not be used by vehicles larger than a 1.5-ton pickup truck; moving vans must park on the street. Damage from oversized vehicles is assessed to the responsible lot owner.
- Maintenance & nuisances: Each lot must be kept mowed and clear of unsightly objects. No noxious or offensive trade or activity is allowed. Garbage receptacles must be screened from view. Exterior lights must be clear, white, or non-frost. No outside radio/TV antennas or satellite dishes without Declarant's written approval. No yard or garage sales are permitted.
- Fences & common driveways: A privacy fence along the south lot line is required, with an $800 deposit held in escrow for construction; ongoing maintenance costs are shared pro rata among lot owners. No other fences are allowed. Each lot has a common driveway; owners benefiting from it share one-half of maintenance costs.
