What Barclay Hills's governing documents say
This is a set of restrictive covenants for Barclay Hills Subdivision, Section A, a single-family home subdivision in Wilmington, NC. The rules apply to all lot owners and are designed to maintain a residential character.
- Residential use only: All lots must be used for residential purposes only. Only one detached single-family dwelling (max 2½ stories) and a private garage for up to three cars are allowed per lot. No trailers, tents, or outbuildings may be used as residences before the main house is built.
- Setbacks & lot subdivision: Buildings must be at least 50 feet from the front street line (but no more than 65 feet) and at least 12 feet from side property lines. Lots cannot be re-subdivided unless the resulting parts become part of whole lots.
- Nuisance & offensive activities: No noxious or offensive trade or activity may be carried on, and no use may become an annoyance or nuisance to the neighborhood.
- Architectural review: Building designs must be approved by the developer (Business Properties, Inc.) or its agent. The developer has 10 days to approve or disapprove plans; if no response, approval is not required as long as the design is in harmony with existing structures. Minimum interior floor area is 1,050 square feet. Dwellings must be wood, brick, brick veneer, tile, stucco, or concrete and stucco; garages must match the dwelling's materials.
- Construction timeline: Once a structure is begun, the entire exterior must be finished within one year from the date the foundation is laid.
- Duration & amendment: These covenants are binding until October 31, 1981, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any lot owner may sue to enforce these covenants or recover damages for violations.
