If sold or transferred during that period, the City of San Antonio can recapture the outstanding loan balance ($43,034.33). Transfer due to death may allow deferral if the transferee qualifies for the CDBG program and assumes the loan.
- 2020 Restrictive Covenant of Affordability (San Antonio, TX) – Occupancy & recapture: The owner (Cecilia Ann Guereca) must occupy the property at 7119 Cahill Street as her principal residence for five years from March 6, 2020. If sold during that period, the City can recapture the outstanding loan balance ($10,956) plus any other HOME assistance that reduced the purchase price, but not exceeding net proceeds. If the owner stops occupying without selling, the City can demand repayment of the same amount.
