What Capri Estates's governing documents say
Capri Estates is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and are designed to maintain a uniform residential character.
- Residential use only: All lots must be used solely for residential purposes. No portion of a lot may be used as a public or private roadway, except for a driveway incidental to residential use.
- Building restrictions: Only one detached single-family dwelling (max two stories) and a private garage (max one story, for up to two cars) may be built per lot. Garage apartments are expressly prohibited. No temporary structures, trailers, mobile homes, tents, shacks, barns, or other outbuildings may be used as residences.
- Architectural review: No dwelling or other structure may be erected on any lot without prior approval of plans and location from Pioneer Development Company, its successors, or assigns.
- Nuisance & commercial activity: No commercial, noxious, or annoying trade or activity may be carried on any lot. Nothing may become an annoyance or nuisance to the neighborhood.
- Animals: Hogs, cattle, sheep, goats, horses, poultry, and other livestock are prohibited. Dogs, cats, and other household pets may be kept, but not for commercial purposes.
- Waste & sanitation: No dumping of rubbish, trash, garbage, or other waste. Waste must be kept in sanitary containers. Incinerators or disposal equipment must be kept clean. Surface closets and outhouses are prohibited. Sewage disposal must be by septic tank complying with state health board requirements until a general sewage system is installed.
- Lot subdivision: No lot may be subdivided unless the subdivided part becomes part of a whole lot and the remaining part becomes part of another whole lot.
- Duration & enforcement: These covenants run with the land for 20 years from the date of the declaration (September 1966), automatically renewing for successive 10-year periods unless a majority of lot owners record a change. Any lot owner may bring legal proceedings to enforce the covenants or recover damages.
