What Capri Place's governing documents say
Capri Place is a standard single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners, tenants, and occupants, and are designed to protect property values and ensure compliance with a state stormwater permit.
- What you own & maintain: You own your lot and house; the HOA maintains common areas (drainage easements, retention/detention ponds) and may maintain certain easements on lots 1-3. Owners of lots 4-7 must mow and maintain drainage easements on their property.
- Assessments & fees: Initial annual assessments: $100 for vacant lots, $204 for lots with houses (collected quarterly). The HOA can increase assessments up to 10% per year without member vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require 2/3 approval. Assessments are a personal obligation and a lien on the lot if unpaid.
- Use restrictions: Lots are for residential use only. No mobile homes, modular homes, temporary structures, or commercial activity. No farm animals or poultry; house pets allowed but must be leashed and not a nuisance. Owners must keep lots mowed and free of debris.
- Architectural review: The Declarant (developer) has sole architectural control until the last lot is sold; after that, no architectural review is required. Construction or reconstruction by an owner must be completed within 9 months unless extended by the Architectural Control Committee.
- Stormwater & drainage: Each lot has a maximum impervious (built-upon) area of 2,330 square feet. Drainage easements must be maintained; filling or piping of vegetative conveyances is prohibited. The HOA is responsible for stormwater facilities and must take over the state stormwater permit when required.
- Leasing & rentals: The document does not address leasing restrictions, minimum lease terms, or rental caps. (This document does not cover leasing rules.)
- What this document doesn't cover: This document does not cover leasing restrictions, pet limits (beyond no farm animals), parking rules, age restrictions, or amenity details. It is a declaration of covenants, conditions, and restrictions (CC&Rs) for a subdivision, not a full set of HOA rules or bylaws.
