Sandfiddler Pointe is a single-family home HOA in Wilmington, NC. The rules apply to all lot owners, tenants, and occupants. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that governs the community.
- What you own & maintain: You own your lot and house. The association owns and maintains the common areas (including roadways) and carries liability insurance of at least $1,000,000. Each owner pays a pro-rata share (10% of operating expenses) for common area maintenance.
- Architectural review: Any new structure or exterior change requires prior written approval from the Board or an architectural committee. If no decision within 30 days, approval is deemed given. Minimum house size: 2,000 sq ft (one-story) or 2,400 sq ft (two-story, with at least 1,800 sq ft on first floor). No more than 25% of lot may be covered by structures or paved surfaces. Exterior finish must be primarily brick, cedar/wood, or stucco.
- Leasing & rentals: No lease for less than one year. Violation results in a $1,000 per day penalty.
- Pets: Household pets (dogs, cats, etc.) are allowed but not for commercial purposes. They must be leashed and escorted at all times. No livestock or poultry.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, constructed of concrete, brick, or asphalt. On-street parking is for guests only. No inoperable or unregistered vehicles allowed; association may tow at owner's expense. Boats, campers, trailers, and similar vehicles must be stored out of sight in garages unless association consents.
- Assessments & fees: Annual assessments are based on actual maintenance costs plus 5% for inflation. Maximum annual increase without membership vote is 10% per year. Special assessments for capital improvements require 67% owner approval. Unpaid assessments accrue 12% annual interest and become a lien on the property.
- Fines & enforcement: For rule violations, the association gives written notice and 15–30 days to cure. If not cured, fines start at $100 per week for the first four weeks, then $250 per week thereafter. Legal fees may be charged to the homeowner, and a lien may be placed on the lot.
