What Alexander Estates's governing documents say
Alexander Estates is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and are designed to maintain the residential character of the neighborhood. Key features include private streets maintained by the HOA, allowances for mobile and modular homes, and a 10-year initial term for the covenants with automatic renewals.
- Residential use & allowed dwellings: All lots are for single-family residential use only. One single-family residence, mobile home, or modular home is permitted per lot. There is no minimum size for a dwelling.
- Homeowners association & assessments: Every lot owner is a member of the Alexander Estates Homeowners Association. The HOA collects annual and quarterly assessments (amounts set by the association) to maintain private streets, carry insurance, pay taxes on common areas, and enforce the rules. Delinquent assessments become a lien on the lot and bear interest at the maximum legal rate.
- Private streets & maintenance: All streets in the subdivision are private and maintained by the HOA. Each lot owner has a right of ingress and egress over the private streets. The HOA may eventually offer streets to the state for public maintenance.
- Pets: No livestock or poultry are allowed. Dogs, cats, or other household pets are permitted but must be leashed and not kept for commercial purposes.
- Setbacks & site plan approval: Buildings must be at least 10 feet from side property lines and 30 feet from any subdivision road right-of-way or easement. Before construction or placement of a dwelling, owners must submit a site plan to the developer (or later the HOA) for approval; disapproval must occur within 10 days.
- Lot division & use: Lots cannot be subdivided without the developer's written consent. A single lot is the minimum building area, but multiple lots may be combined as one building plot.
- Maintenance & nuisance: Owners must keep their lot clean and free of rubbish, and avoid any activity that causes excessive noise, odors, or disturbance to neighbors. Garbage receptacles must be secured and not visible from the road.
- Duration & amendments: The covenants last for 10 years from the recording date (July 1987) and automatically renew for successive 10-year periods unless a majority of lot owners vote to terminate. The developer has the right to amend the covenants until development is complete, after which the HOA may have amendment authority.
