What Gable Run's governing documents say
Gable Run is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This document is the master declaration of covenants that applies to all lots in the subdivision, binding current and future owners. It covers land use, building standards, maintenance obligations, stormwater management, and HOA assessments.
- Land use & building type: Lots are for residential use only. Only single-family dwellings (max 3 stories) are allowed, with a minimum heated area of 1,500 square feet. Exterior colors and mailbox designs require prior approval from the Declarant or its assign.
- Setbacks & building location: Buildings on the periphery must be set back at least 20 feet from adjoining property lines. Detached single-family homes must be at least 10 feet apart; multiple dwelling units must be at least 20 feet apart.
- Pets & animals: No livestock or poultry. Customary household pets (dogs, cats) are allowed but must not create a noise or smell nuisance. Pets must be confined to the owner's lot by fencing or invisible fencing, and must be leashed when off the lot. No tethering to immovable objects.
- Fences: Fences up to 6 feet high, made of wood or vinyl, are permitted. Chain link fences are prohibited. No fence is allowed between the front of the dwelling and the street right-of-way without Declarant approval. Corner lots require prior written approval for any fencing.
- Parking & vehicles: No boats, boat trailers, campers, or RVs may be parked between the front of the dwelling and the street right-of-way unless in the paved driveway. Recreational vehicles must be parked in a privacy-fenced area behind the dwelling or inside a garage/carport. No portable basketball goals in the right-of-way.
- Stormwater management: Each lot has a maximum built-upon area of 4,000 square feet. A 50-foot vegetated buffer must be maintained adjacent to water bodies. Roof drains must terminate at least 50 feet from water features. Alteration of drainage requires state approval. The HOA is responsible for maintaining stormwater facilities after transfer from the Declarant.
- HOA assessments & fees: Annual general assessment was $250 per lot until January 1, 2017. After that, the Board may increase it by up to 15% per year without member vote; increases over 15% require approval of two-thirds of lot owners. Assessments are a lien on the lot and the personal obligation of the owner at the time they fell due. Special assessments may be levied for stormwater or common area expenses.
- Maintenance obligations: Each lot owner must maintain their lot, including vegetation, in an aesthetically landscaped appearance. Owners must also maintain easement areas on their lot, except those maintained by the HOA or utilities. If an owner fails to maintain, the Declarant or HOA may enter the lot to perform maintenance and charge the owner.
