Orchard Park at West Bay Estates is a standard single-family home HOA in Wilmington, NC. The rules apply to all lot owners, tenants, and occupants, and are designed to protect property values and maintain a uniform residential character.
- Land use & building type: All lots are single-family residential only. Minimum heated floor area is 1,400 square feet (exclusive of porches, garage, etc.), and at least a two-car garage is required. Modular, prefabricated, or previously constructed houses are not allowed.
- Setbacks & impervious surface: Houses must be at least 25 feet from the front lot line. No more than 4,500 square feet of any lot may be covered by structures or paved surfaces (excluding wood decks/walkways that allow water infiltration).
- Exterior materials & colors: Prohibited exterior materials include concrete block, concrete brick, asbestos siding, aluminum siding, cinder block, and tar paper. Acceptable materials are conventional frame, brick, wood, clay brick, vinyl, or wood composite. Window coverings visible from outside must be white or neutral; exterior light bulbs must be clear or white.
- Fences & storage buildings: Fences must be pressure-treated wood, natural in color, no taller than 6'8", and cannot be placed forward of the back corner of the house. Storage buildings must be on the back third of the lot, no larger than 80 square feet, match the house materials and colors, and not exceed impervious surface limits.
- Vehicles, boats & parking: No house trailers, mobile homes, travel trailers, campers, or recreational vehicles may be stored or used as residences. Boats must not be visible from any street. Off-street parking for at least four automobiles must be provided on each lot.
- Pets & nuisances: No noxious or offensive activities allowed. Dogs and cats must be under owner's control at all times and housed inside. Dog runs are not permitted. No domesticated farm animals or fowl. No yard or garage sales more than once every 12 months. No clotheslines.
- Architectural control: No structure or exterior alteration (including painting) may begin without written approval from the Declarant (developer) as long as the developer owns a lot. Approval may be based on any ground, including aesthetics, in the Declarant's sole discretion.
- Maintenance responsibilities: Lot owners are responsible for maintaining the lot, including the area from the lot line to the edge of the paved street, and for keeping it mowed and clear of unsightly objects. Owners of certain lots are also responsible for maintaining specific streets (Orpin Court, Corum Lane, Peters Lane) as shown on the recorded plat.
