Ogden Pines is a standard single-family home HOA in Wilmington, NC. This Declaration of Covenants, Conditions, and Restrictions (CCRs) establishes the HOA and sets rules for all lot owners. The document covers assessments, architectural control, use restrictions, and common area maintenance.
- What you own & maintain: You own your lot and dwelling. The Association maintains common areas (open space, stormwater drainage, entrance, subdivision sign) and utility easements. Individual lot owners are responsible for water wells, sewer tap fees, and interior/exterior maintenance of their homes.
- Architectural review: All exterior changes (including paint color, fences, structures) require prior written approval from the Declarant or Architectural Control Committee. Plans are deemed approved if no response within 30 days. Minimum dwelling size is 1,000 sq ft enclosed area (excluding garage, decks, porches). Doubl-wide manufactured homes are allowed with a concrete block or brick veneer curtain wall.
- Assessments & fees: Annual assessments are levied per lot and can increase up to 10% per year without a membership vote; higher increases require 2/3 vote of each class. Special assessments for capital improvements also require 2/3 vote. Assessments are due quarterly and become a lien if unpaid. Insurance assessments are additional.
- Use restrictions: Lots are for residential use only. No noxious activities, junk vehicles, or tractor-trailers. Temporary structures (trailers, tents) cannot be used as residences. Boats, campers, and RVs must be parked in the back yard out of street view. Fences cannot exceed 6 ft and must match approved design; corner lots require a 20'x20' fenced storage area.
- Signs: No 'For Sale' or 'For Rent' signs are allowed on lots or common areas without written permission from the Developer or Association (after turnover). Developer may place directional signs for up to 5 years.
- Parking & vehicles: Off-street parking for at least 2 cars must be provided on each lot. Inoperable vehicles without current registration, inspection, license plate, and insurance are prohibited and may be towed at owner's expense.
