McCormick Place is a single-family residential subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1992. These covenants run with the land and bind all lot owners, with a 20-year initial term that auto-renews every 10 years unless a majority votes to revoke or amend.
- Land use & lot rules: Lots are for single-family residential use only. No lot may be resubdivided unless each part becomes part of another contiguous whole lot.
- Minimum dwelling size: Any dwelling must have at least 720 square feet of heated living area (exterior foundation measurement, excluding porches, decks, garages, etc.).
- Mobile homes: Only commercially built mobile homes or house trailers at least 12 ft wide and 60 ft long are allowed. No mobile home more than 6 years old from the date of recording (1992) is permitted unless waived in writing by the Developer or assigns. All mobile homes must be on permanent foundations and underpinned with approved materials.
- Setbacks & building placement: No residence may be nearer than 35 ft to the front street line, 20 ft to the rear property line, or 10 ft to any side boundary line (or 20 ft to any adjacent residential structure). If an owner uses two or more contiguous lots for one residence, the interior boundary lines are disregarded.
- Drainage & easements: Each lot owner must install and maintain a culvert or drain pipe (minimum 15-inch diameter) under their driveway to ensure natural drainage. Owners are responsible for maintaining drainage easements on their lots; no structures or plantings may interfere with utilities or drainage flow.
- Property maintenance & nuisances: No inoperative junk cars, appliances, boats, or wreckage may be kept on any lot. All homes and lots must be kept orderly and free of trash. Noxious or offensive trades or activities are prohibited. The association may clean up a neglected lot at the owner's expense and place a lien.
- Pets & animals: No horses, cattle, swine, poultry, or other livestock are allowed. Dogs, cats, or other household pets are permitted but not for commercial purposes.
- Utilities & roads: Electrical power lines must be installed underground from the utility pole to the meter. The Developer may contract for street lighting with a monthly charge to each lot owner. Maintenance of the private road is governed by a separate Road Maintenance Agreement.
