Marathon Farms is a single-family home subdivision in Wilmington, NC, governed by a 1974 Declaration of Restrictions that runs with the land. These covenants apply to all lot owners and are designed to maintain a residential character with minimum home sizes and setback requirements.
- Residential use only: All lots must be used for residential purposes only. Only one detached single-family dwelling, a private garage for up to two cars, and incidental outbuildings are allowed.
- Minimum home size: Dwellings must have at least 1,500 square feet of interior area. If interior space is at least 1,250 square feet, the developer may approve a smaller home if additional porch or garage space under the main roof brings the total to 1,500 square feet.
- Setbacks & height: Buildings must be at least 40 feet from the front lot line, 10 feet from side lot lines, and 5 feet from the rear lot line. No structure may exceed two and a half stories.
- Prohibited structures: No trailer, mobile home, shack, tent, barn, or similar structure may be placed on any lot for temporary or permanent living quarters.
- Architectural review: Building design and materials must be approved by the developer (Foster-Hill Realty Co., Inc. or Edw B. Ward). Approval is deemed given if no response within 10 days of written request, provided the design is in harmony with existing structures.
- Construction timeline: The entire exterior of all structures must be completed within six months of laying the foundation, unless an extension is granted in writing by the developer.
- Utilities & drainage: Water for human consumption must come from a source approved by the health department. Sewerage and waste disposal must meet state or county health requirements. Each owner must install and maintain a culvert or drainage pipe at least 15 inches in diameter and 20 feet long under their driveway, with masonry retaining walls at each end.
- Nuisance & offensive activities: No noxious or offensive trade or activity may be conducted on any lot, nor any use that becomes an annoyance or nuisance to the neighborhood.
