Marathon Landing is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1987. The rules apply to all lot owners and are designed to maintain a uniform residential character. The community includes a boat landing and recreational area managed by a homeowners association.
- Residential use only: All lots are for single-family residential use only; no commercial activity is allowed. Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars may be built per lot.
- Architectural review: Plans for any dwelling must be approved by the Declarant (or its agents) before construction. Approval is automatic if not acted upon within 10 days, provided the design is in harmony with existing structures.
- Minimum house size: Dwellings must have at least 1,350 square feet of living space (excluding porches, garages, etc.). The Declarant may approve a dwelling up to 10% smaller if it fits the subdivision's character.
- Exterior materials & fences: Dwellings must be wood, brick, brick veneer, or stone; garages must match. Chain link fences over 4 feet are prohibited; other fences over 4 feet require written approval. No fence may be placed nearer the front than the back corners of the house.
- Temporary structures & mobile homes: No house trailers, mobile homes, tents, shacks, or temporary residences are allowed. Modular and prefabricated homes require express written consent from the Declarant.
- Nuisance & vehicles: No offensive or noxious activities are permitted. Inoperative cars must not be kept on any lot.
- Boat landing & association assessments: A boat launching ramp and recreational area is reserved for lot owners, their families, tenants, and contract purchasers. The Marathon Landing Association may levy annual assessments (initially capped at $100/lot until 1991, then adjustable by 60% vote) and special assessments (by 2/3 vote) for maintenance and capital improvements. Unpaid assessments bear 8% annual interest and become a lien on the property.
