Rocky Run Subdivision is a standard single-family home HOA in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) apply to all lot owners and are designed to preserve property values and ensure uniform development.
- Land use & building type: All lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) plus a private garage for up to 2 cars and incidental outbuildings are allowed. No trailers, mobile homes, shacks, tents, barns, or similar structures for living quarters.
- Minimum house size: Dwellings must have at least 1,500 square feet of interior area. If interior space is at least 1,450 square feet and there is additional porch or garage space under the main roof, the total area (including porch/garage) must be at least 1,500 square feet. The developer may approve smaller dwellings if they conform to the subdivision's general development.
- Setback requirements: Buildings must be at least 40 feet from the front lot line, 10 feet from side lot lines, and 5 feet from the rear lot line.
- Architectural review: Building designs must be approved by the developer (or successors/assigns). If the developer fails to approve or disapprove within 10 days of a written request, approval is not required as long as the design is in harmony with existing structures. All building materials must be approved by the developer.
- Construction timeline: The entire exterior of all structures must be completed within 6 months from the date the foundation is laid, unless an extension is granted in writing by the developer.
- Utilities & drainage: Water for human consumption must come from sources approved by the New Hanover County Health Department. Sewerage and waste disposal must meet state or county health requirements. Each property owner must install and maintain a culvert or drainage pipe under their driveway (minimum 15 inches in diameter, at least 20 feet long) to avoid blocking natural drainage.
- Nuisance & prohibited activities: No noxious or offensive trade or activity may be carried on any lot. No use may become an annoyance or nuisance to the neighborhood.
- Duration & amendment: These covenants run with the land and were originally effective until January 1, 2000, with automatic 10-year extensions unless a majority of lot owners vote to change them in whole or in part.
