Woodcrest Subdivision is a standard single-family home HOA in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all lot owners. The document was recorded in 1987 and automatically renews every 10 years after the initial 25-year term unless a majority of owners vote to revoke or amend.
- Lot use & building restrictions: Lots are for single-family residential use only, minimum 20,000 sq ft. Each lot may have one detached single-family dwelling (max 2.5 stories), a private garage for up to 2 cars (which may include servant quarters), and appurtenant outbuildings. Minimum enclosed dwelling area is 1,600 sq ft (excluding porches, steps, walks, breezeways, carports, and garages). No business, trade, or occupation may be conducted on any lot.
- Setbacks & lot dimensions: Front setback: at least 30 ft from front lot line (or the building line established by prior residences). Side street (corner lot): at least 15 ft. Side yard: at least 10% of average lot width. Rear setback: at least 25 ft. For lots narrower than 90 ft at the 30-ft front setback line, the house must be placed so that lot width at the house's furthest forward point is at least 90 ft.
- Architectural review: No building, fence, wall, or other structure may be erected or altered, and no grading or change to the lot's physical characteristics may be made, until plans (including building plans, site plan, grading plan, exterior colors/finishes, and construction schedule) are submitted to and approved in writing by Declarant. Declarant may refuse approval for any reason, including aesthetic or environmental considerations, in its sole discretion. Two copies of plans must be submitted; one is returned with approval endorsement. Architectural control remains with Declarant as long as Declarant owns a lot.
- Prohibited structures & uses: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as a residence. No outside toilet or privy. No advertising signs or billboards except one sign of no more than 5 sq ft on the front half of a lot to advertise the property for sale or rent. No noxious or offensive trade or activity. No dumping of rubbish, trash, or garbage; no abandoning, storing, dismantling, or repairing vehicles on a lot. No fuel tanks exposed to view.
- Pets & animals: No animals, livestock, or poultry may be raised, bred, or kept except dogs, cats, or other household pets, which may not be kept for commercial purposes. Dogs must be kept in a fenced area or leashed at all times while outside the dwelling.
- Vehicles & parking: No inoperative junk cars, large trucks, buses, or other eyesores may be maintained or stored on a lot. Recreational vehicles are allowed but must be concealed from view of the general public and adjacent lot owners. Driveways must be paved with headers (brick, stone, or stuccoed masonry) at culverts.
- Fences & landscaping: No fence may be erected nearer than the back side of the residence. Maximum fence/hedge height: 8 ft. No chain link or hurricane fence visible from the front of the house. On corner lots, no fence, wall, hedge, or shrub may obstruct sight lines; trees/shrubs within sight lines must have foliage maintained high enough to avoid obstruction. No structure, planting, or material may interfere with drainage facilities or change drainage flow within easements.
- Utilities & easements: All power, phone, cable, and miscellaneous lines must be run underground from the residence to the poles. Declarant reserves perpetual easements over/under the ground for utilities (electric, telephone, cable, gas, water, sewer, etc.) as shown on the plat. Lot owners are responsible for maintenance within easements except for improvements maintained by public or utility companies. No well may be used without written consent of the franchisee/licensee.
