What Virginia Woods's governing documents say
Virginia Woods is a standard single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and are designed to protect property values and maintain a uniform residential character.
- What you own & maintain: You own your lot and the house on it. You are solely responsible for maintaining the exterior and interior of your home, including roofs, windows, and yard (trees, shrubs, grass). The HOA can step in to make repairs if you fail to do so, and charge you for the cost.
- Architectural review & construction standards: All construction plans must be approved by the developer (or later the HOA). Minimum house size: 1,200 sq. ft. for two-story homes; no single-story homes allowed. Exteriors must be conventional frame or clay brick (no concrete block, aluminum siding, or composition tar paper). At least 80% of the residence must be on crawl space.
- Leasing & rentals: The document does not restrict leasing or rentals. However, signs advertising 'For Rent' are permitted.
- Pets: Only domesticated pets are allowed. No farm animals or fowls.
- Parking & vehicles: No inoperative junk cars, large trucks, or buses may be stored on the property. Recreational vehicles are allowed.
- Fences: Fences cannot exceed 4 feet in height in front of the house's rear corners; privacy fences up to 8 feet are allowed on the back lot line. Materials must be wood or brick; no chicken wire or other wire materials.
- Signs: No signs or billboards except private name plates and 'For Sale' or 'For Rent' signs.
- Assessments & liens: The HOA can assess costs for road repair and exterior building maintenance if approved by 62% of owners. Unpaid assessments become a lien on the property and the owner's personal obligation, with interest and attorney's fees.
