What Jamesborough Court Condominium's governing documents say
This is a partial, ancillary document — a set of protective covenants between a developer (TCHAM V, LLC) and the Jamesborough Court Condominium Owners Association. It does not contain the full condominium rules for residents. Instead, it restricts how the developer may use a specific adjacent parcel (the TCHAM Parcel) to protect the association's property and views. The covenants run with the land and benefit the condominium.
- Landscaping & improvements on adjacent parcel: The developer (TCHAM) cannot build any structures other than a driveway, parking area, landscaping, and utility easements within a defined 'Landscape Area' on its parcel. Landscaping must be maintained by TCHAM and be of quality at least similar to what currently exists.
- Driveway & parking restrictions: If TCHAM builds a driveway connecting to the condominium's existing driveway, it must not eliminate any clearly marked parking spaces on the condominium's property. The driveway portion within the Landscape Area must be paved, no wider than 16 feet (excluding curbing), and of similar materials to the existing driveway. Any unit using that driveway must have at least 2.5 parking spaces.
- Parking setback from condominium property: No parking areas on the TCHAM Parcel may be located closer than 15 feet from the rear-most property line of the condominium (the line shown as Line L12 on Condo Book 15, Page 72).
- Duration & termination: The protective covenants run in perpetuity unless terminated by a written agreement of the then-owners of the benefited parcel (the condominium association) or if the same owner holds title to both parcels.
- What this document doesn't cover: This document does not contain the condominium's declaration, bylaws, or rules for unit owners. It does not address pet limits, lease restrictions, assessments, or other typical HOA/condo rules. Those would be found in the condominium's master declaration and other governing documents.
