Baywood Subdivision is a single-family home HOA in Wilmington, NC. Every lot owner automatically becomes a member of the Baywood Association and has one vote per lot. The rules are designed to protect property values and apply to all owners, their heirs, and assigns.
- Use restrictions: All lots must be used for residential purposes only. No house trailers, mobile homes, tents, shacks, or temporary structures may be used as a residence.
- Minimum house size & exterior materials: Single-story residences must be at least 1,200 square feet (exterior measurement, excluding porches, steps, garages, etc.). Exteriors must be conventional frame or clay brick; concrete block, concrete brick, aluminum siding, cinder block, and composition tar paper are prohibited.
- Setbacks & lot subdivision: Buildings must meet the minimum front and side setbacks of New Hanover County zoning regulations. Lots may not be resubdivided unless each portion becomes part of another whole lot.
- Signs: No signs or billboards are allowed except private name plates, identification signs for residents, and 'For Rent' or 'For Sale' signs.
- Fences: Fences cannot exceed 4 feet in height and must be set back from the front lot line to at least the rear corners of the house. Privacy fences up to 8 feet are allowed on the back lot line. Permitted materials are wood or chain-link; chicken wire or other wire materials are not allowed.
- Nuisances & animals: No noxious or offensive trade or activity is permitted. Domesticated farm animals and fowls are prohibited; only domesticated household pets are allowed. Inoperative junk cars, large trucks, buses, or similar eyesores may not be stored on the property, though recreational vehicles are allowed.
- Maintenance & assessments: Each owner is responsible for maintaining their unit and lot, including exterior surfaces, roofs, windows, trees, shrubs, and grass. The association may step in to perform exterior maintenance if an owner fails to do so, after a 62% vote of owners. Special assessments for road repair and exterior maintenance can be levied, and unpaid assessments become a lien on the lot, bearing interest at 15% per annum after 30 days.
- Insurance: Each owner must maintain casualty and liability insurance on their lot and improvements, with coverage that cannot be cancelled without 30 days' notice to the association. If an owner fails to insure, the association may obtain insurance and charge the cost as a lien.
