Village of the Pines is a residential subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1989. These covenants run with the land and bind all lot owners, who are also mandatory members of the Beau Rivage Homeowner's Association. The document establishes rules for construction, use, and maintenance to preserve the community's character.
- Residential use only: All lots must be used for residential purposes only. No trailers, mobile homes, tents, or temporary structures are allowed as residences or storage.
- Minimum home size: Each residence must have at least 1,300 square feet of heated living area. The developer may set higher minimums for future sections.
- Architectural review: All buildings, fences, walls, landscaping, and mailboxes require prior written approval from the Developer (or its designee) to ensure conformity and harmony. Plans are deemed approved if no response is given within 30 days.
- Construction timeline: Exterior construction must be completed within six months of starting. Landscaping must be completed within 30 days of receiving a certificate of occupancy, and sod is required (no seeding).
- Party walls and shared roofs: Residences share a common wall and roof along property lines. These party walls cannot be altered. Repair costs are split equally between adjoining owners, and each owner must insure their premises at 80% of value.
- Pets: Only normal household pets are allowed. They must be kept within the premises, in a fenced area, or on a leash at all times.
- Homeowner's Association and assessments: All lot owners automatically become members of the Beau Rivage Homeowner's Association. Annual assessments started at $100 per lot in 1989, plus a $200 special assessment for security gate houses. The Board can increase annual assessments up to 10% per year without a vote; higher increases or special assessments require a two-thirds member vote. Unpaid assessments bear 12% interest and become a lien on the lot.
- Prohibited activities: No yard sales, garage sales, noxious activities, or nuisances are allowed. Lots must be kept clean and attractive. Fuel tanks must be screened or buried.
