What South Amsbury's governing documents say
South Amsbury is a standard single-family HOA in Wilmington, NC. The Declaration of Covenants and Restrictions binds all lot owners and residents to rules about property use, maintenance, assessments, and community standards. This document is the full rulebook for the neighborhood.
- What you own & maintain: You own your lot and living unit. The Association handles exterior maintenance (roofs, gutters, exterior surfaces, trees, shrubs, grass, walks) but not doors, windows, screens, frames, rear decks, skylights, glass, or landscaping. Owners must keep their lot neat and free of debris.
- Assessments & fees: Annual assessments are levied per lot. Increases over 10% require 2/3 owner vote. Special assessments for capital improvements also need 2/3 approval. A working capital fee equal to two months' estimated assessment is due at closing. Late payments incur 18% annual interest and a $15 late fee.
- Architectural review: No building, fence, wall, structure, landscaping change, or tree removal may begin without written approval from the Board or an Architectural Review Committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Pets: No more than four household pets per lot. Pets must be leashed when outside and not confined, and owners must clean up pet debris. No livestock, poultry, or animals that interfere with quietude or safety are allowed.
- Parking & vehicles: Inoperable vehicles, vehicles without current registration/inspection/plates/insurance, and tractor-trailers are prohibited. No boat, camper, trailer, or mobile home may remain on a lot or in parking spaces without Association consent. Vehicle repairs must be completed in one day; no parking on lawns, roadways, or common areas.
- Use restrictions: Lots are for residential use only. No 'For Sale' signs (except by Declarant), no temporary structures as residences, no outdoor clotheslines, no exposed fuel tanks, no colored exterior lights except holiday decorations, and no visible trash receptacles, lawn furniture, toys, or stored materials. Window coverings visible from outside must be white or neutral unless approved.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. If destroyed by fire, any owner who used the wall must restore it unless the other agrees otherwise.
