River Pointe at Beau Rivage Plantation is a planned single-family home community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full set of covenants and restrictions that apply to all lot owners, residents, and their guests. It covers what you own, what the HOA maintains, and the rules for living here.
- What you own & maintain: You own your lot and the living unit on it. The HOA handles exterior maintenance of roofs, gutters, exterior surfaces, trees, shrubs, grass, and walks, but not doors, windows, window screens, frames, rear decks, roof skylights, or glass surfaces.
- Architectural review: No building, fence, wall, structure, planting, landscaping change (including tree removal), or exterior alteration may be made without written approval from the HOA's Architectural Review Committee. Plans are deemed approved if not acted on within 30 days.
- Use restrictions & nuisances: Lots are for residential use only. No noxious or offensive activities, junk vehicles, inoperable vehicles, tractor-trailers, recreational vehicles (boats, campers, mobile homes), temporary structures as residences, outside antennas (except small satellite dishes), or outdoor clotheslines are allowed. No furniture is permitted in common areas unless provided by the HOA.
- Pets: No more than four household pets per lot. Pets must be leashed when outside, and owners must clean up pet debris. Excessive barking that creates a nuisance is a violation.
- Parking & vehicles: Parking spaces adjacent to a lot are for that lot's owner; other parking is shared. No parking on lawns or blocking streets. Vehicle repairs must be completed in one day, and no vehicle may remain on jacks or stands for more than one day.
- Leasing & rentals: The document does not restrict leasing terms or require owner occupancy. Leases are permitted, but tenants must comply with all rules.
- Assessments & fees: All lot owners (except Declarant) pay annual assessments and may be subject to special assessments for capital improvements. Assessments are a lien on the lot. Late payments incur 18% annual interest and a $25 monthly late fee. A working capital fee equal to two months' estimated assessment is due at closing.
- Common areas & amenities: All owners have an easement to use common areas, including streets, walkways, and designated parking. The HOA may build recreational amenities (pool, clubhouse, playground) but is not obligated to. The HOA maintains stormwater retention ponds and private roads.
