What Rivergate's governing documents say
Rivergate is a 610-acre industrial/commercial development in Wilmington, NC, governed by restrictive covenants recorded in 1976. These covenants bind the property owners and are designed to control industrial use and protect adjoining residential areas. The document is a declaration of restrictions, not a homeowners' association rulebook.
- Permitted uses & industrial restrictions: Industrial use requires a special use permit from New Hanover County and approval by the property owners. No industry may become a nuisance due to smoke, dust, glare, odor, fumes, noise, or vibrations. No use may increase insurance rates or depreciate adjoining property values.
- Building & construction standards: All buildings must be fireproof and constructed of masonry or other strong material; wooden or frame construction is prohibited in exposed exterior positions. Plans and specifications must be approved in writing by the owners for design harmony and location. No more than 35% of the total land area may be covered by buildings.
- Setbacks & buffer zones: Buildings along US Highway 421 or River Road must be set back at least 200 feet from the street right-of-way. A 200-foot buffer zone is required where the property adjoins residentially zoned land: the first 100 feet must be planted with trees/shrubs forming an obscuring screen at least 12 feet high, and the remaining 100 feet must be a landscaped green area or landscaped employee parking. Existing trees and ground cover in the planted buffer may not be removed.
- Parking & traffic: Off-street parking must be provided for employees, customers, and visitors, but not in the planted buffer zone. No street parking is permitted on site or on River Road or US Highway 421. All entrances, exits, deliveries, and pickups must use the US Highway 421 access area; River Road beyond the property boundaries may not be used for industrial operations.
- Lighting restrictions: All lighting must be placed, shielded, or concealed so that it is not visible from any residential structure.
- Environmental study requirement: Before any sale of land to an industry, a complete land use and environmental study must be prepared and submitted with a special use permit application to the County Commissioners.
- Duration & amendment: The covenants run for 99 years from the date of the declaration (1976) and cannot be removed without the written consent of all adjoining property owners whose land is zoned residential.
- What this document doesn't cover: This document does not create a homeowners' association, set fees or assessments, regulate residential use, or address leasing, pets, or age restrictions. It is a set of restrictive covenants for an industrial/commercial development.
