Oasis Subdivision is a standard single-family home HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all homeowners in the subdivision.
- Architectural review: All exterior changes (including painting, fences, and new structures) require prior written approval from the Architectural Control Committee. Plans are deemed approved if not acted on within 30 days. Minimum dwelling sizes: 2,500 sq ft for single-story, 3,200 sq ft for multi-story (at least 1,700 sq ft on first floor).
- Use restrictions: Lots are for single-family residential use only. No temporary structures, trailers, or tents may be used as residences. No boats, campers, trailers, or inoperable vehicles may be stored on lots or streets without Association consent. Clotheslines are prohibited.
- Assessments & fees: Each lot owner pays annual assessments, plus possible special, insurance, ad valorem tax, and working capital assessments. A $200 working capital fee is due at closing from the first owner. Assessments are a lien on the lot if unpaid for 30+ days.
- Maintenance responsibilities: The Association maintains common elements (private roads, greenways, parks, stormwater basins) and may provide lawn care for front/side yards. Owners must keep their lots mowed, clear of unsightly objects, and maintain landscaping in fenced backyards and along ditches/ponds.
- Developer rights: The developer (Declarant) retains special rights until the Declarant Control Period ends (when Class A votes equal Class B, or by Dec 31, 2012, or voluntary surrender). These include appointing the board, amending the declaration without member vote for certain purposes, and annexing additional property.
- Voting & membership: Each lot owner is a member with one vote per lot. The developer initially has three votes per lot owned. Class B (developer) membership converts to Class A when votes equal, by end of 2012, or upon surrender.
