Rachel Gardens is a single-family home planned community in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners, residents, and guests. Key features include architectural controls, stormwater management requirements, and restrictions on leasing and pets.
- What you own & maintain: You own your lot and the single-family dwelling on it. You must maintain your lawn and landscaping, and keep the property in good condition. The HOA maintains common areas, including roads, streets, and stormwater ponds.
- Architectural review: All exterior changes (houses, fences, driveways, etc.) require approval from the Declarant or, after Declarant control, the Architectural Review Committee. Minimum house size is 1,000 heated square feet. Fences cannot extend forward of the front corners of the house, and chain-link fences visible from streets are prohibited.
- Leasing & rentals: Leases must be for at least six months. Short-term rentals are not allowed.
- Pets: Only domestic dogs and cats (or other household pets) are allowed, and they cannot be kept for commercial purposes or in numbers that create a nuisance.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars. Boats, RVs, and similar vehicles may only be parked on approved driveways or pads. Inoperable vehicles are prohibited and may be towed. No mechanical work on vehicles in front or side yards or streets.
- Stormwater & environmental rules: No more than 2,300 square feet of impervious surface per lot. Swales and ditches cannot be filled or altered except for driveway crossings. Runoff must drain into the permitted stormwater system. These restrictions cannot be changed without state approval.
- Assessments & fees: Annual assessments are set by the board; initial dues were $240/year ($20/month). A one-time working capital assessment of $100 is due at purchase. Special assessments require a two-thirds vote. Unpaid assessments accrue interest and can become a lien on the property.
- Use restrictions: Lots are for single-family residential use only. No temporary structures, modular homes, or mobile homes. No noxious activities, junk vehicles, or signs without permission. Satellite dishes under 18 inches not visible from the street are allowed.
