Pine Hills is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain the residential character of the neighborhood.
- Residential use only: Lots may only be used for residential purposes. No commercial use, noxious activities, or nuisances are allowed.
- Building & setback rules: Only one detached single-family dwelling (max two stories) and a two-car garage per lot. Minimum cost of dwelling: $5,000. Setbacks: at least 40 ft from front line, 8 ft from side lines, 10 ft from side street lines.
- Temporary structures & trailers: No trailers, tents, shacks, or temporary structures may be used as residences. Servant quarters above a garage are allowed only after the main building is completed.
- Waste & sanitation: No dumping of rubbish or waste; must be kept in sanitary containers. Incinerators must be clean. No surface closets; sewage disposal via septic tank meeting state health board requirements until a general system is installed.
- Lot subdivision: Lots cannot be resubdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
