Stonesthrow is a single-family townhome HOA in Wilmington, NC. You own your lot and home, and the association maintains common areas and provides exterior maintenance (roofs, siding, landscaping). The rules apply to all lot owners.
- What you own & maintain: You own your lot and the townhouse on it. The association handles exterior maintenance: roofs, gutters, exterior surfaces, trees, shrubs, grass, walks, and other exterior improvements (but not glass surfaces). If damage is caused by your negligence or certain perils, the repair cost is added to your assessment.
- Architectural review: No building, fence, wall, or exterior alteration may be started without written approval from the board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Assessments & fees: Annual assessments are levied per lot. The maximum annual assessment was originally $420 per lot, and can increase up to 5% per year without a vote; increases above 5% require a 2/3 vote of each membership class. Special assessments for capital improvements also require a 2/3 vote. Assessments are a lien on the property and personal obligation of the owner.
- Use restrictions: Lots are for residential use only. Only one single-family townhouse dwelling, not exceeding 2.5 stories, is allowed. No temporary structures, trailers, or outbuildings may be used as residences. No noxious or offensive activities are permitted.
- Parking & vehicles: Each lot owner is entitled to exclusive use of up to two parking spaces near their lot. The association permanently assigns one parking space per dwelling.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes are resolved by arbitration.
- Leasing & rentals: Owners may delegate their common area use rights to tenants who reside on the property. No minimum lease term or other rental restrictions are stated in this document.
