Bradley Park is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1969. These covenants run with the land and apply to all lot owners, requiring residential use and setting standards for buildings, setbacks, and maintenance.
- Permitted use: All lots are for single-family residential use only. No house trailers, tents, shacks, or temporary structures may be used as residences.
- Building size & height: Each dwelling must have at least 900 square feet of heated floor space on the main floor (excluding porches, garages, etc.) and cannot exceed 2½ stories.
- Setbacks & fences: Buildings must be at least 25 feet from the front property line and at least 10% of the lot's front width from side boundaries. Fences cannot extend beyond the front setback line and cannot exceed 4 feet in height.
- Pets & nuisances: No domesticated farm animals or fowls are allowed. No noxious or offensive activities, and inoperative junk cars or eyesores cannot be kept on the property.
- Signs: Only 'For Sale' or 'For Rent' signs are permitted, and they cannot exceed 2 feet by 3 feet in size.
- Utilities & easements: Water must come from the community system unless approved otherwise. The developer reserves easements along property lines for utility installation and maintenance.
- Amendment & duration: These restrictions can be amended by a written document signed by the developer (or successor) and owners of at least 60% of the lots. If not modified, they remain in effect until September 1, 1999.
