The Mews at Landfall is a single-family home community in Wrightsville Beach, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners and their tenants. The community is part of a larger master-planned development (Landfall) with an additional council (Landfall Council of Associations) that may impose shared assessments and rules.
- What you own & maintain: You own your lot and the home on it. The HOA maintains common areas (including private streets, ponds, bulkheads, and some water/sewer lines) and provides lawn mowing and irrigation from a common well for all lots. You are responsible for exterior maintenance of your home and must meet a minimum landscaping plan.
- Assessments & fees: Annual assessments are levied per lot. The maximum annual assessment was $850 per lot until January 1, 1998; after that, the board can increase it up to 20% per year without a member vote. A two-thirds vote of each membership class is needed for increases over 20%. Special assessments for capital improvements also require a two-thirds vote. Assessments are due in advance (monthly, quarterly, or annually as set by the board). Delinquent assessments accrue 12% annual interest and may result in a lien or personal obligation.
- Leasing & rentals: Leases must be for at least six months; no transient or hotel use is allowed. You cannot lease less than the entire home. All leases must be in writing and state that the lease and occupancy are subject to the governing documents.
- Pets: Only dogs, cats, or other household pets are allowed, and they cannot be kept for commercial purposes. Pets must be kept inside the home or in an area approved by the Architectural Control Committee of the Landfall Council of Associations.
- Parking & vehicles: Adequate off-street parking must be provided on each lot. No parking on streets or common areas is allowed. Trucks, boats, trailers, and commercial vehicles must be stored inside an enclosed garage.
- Use restrictions: All lots and homes are for single-family residential use only. No business, trade, or profession is allowed, except the developer may use up to three homes for sales/display or overnight housing for prospective buyers for up to five years. No lot may be subdivided. Minimum home size is 2,000 square feet (excluding porches, decks, and garages). No more than 75% of a lot may be impervious surface. Signs are prohibited except as required by ordinance.
- Architectural review: All buildings and improvements must be as originally constructed by the developer or approved by the Architectural Control Committee of the Landfall Council of Associations. Any alteration or construction on common areas requires the HOA's written consent.
- Shared assessments with Landfall Council: In addition to HOA assessments, each lot owner must pay shared common expense assessments imposed by the Landfall Council of Associations. These may be billed directly to owners or through the HOA. Late payments may result in a lien and late fees.
