What Lake Breezes's governing documents say
Lake Breezes is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). All lot owners are automatically members of the Lake Breezes Homeowners Association, Inc., which maintains common areas, utilities, and enforces rules. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land.
- What you own & maintain: You own your lot and the house on it. The HOA maintains common areas (easements, common well, access roads) and carries master insurance on association property. Each lot has its own septic system; water comes from a shared well (Lots 2, 3, and possibly 1) or a private well (Lot 4).
- Architectural review: No exterior construction, alteration, or painting may begin without written approval from the Declarant or the HOA's architectural committee. Plans must be submitted; approval may be based on aesthetics alone. Houses must have at least 1,248 square feet of enclosed dwelling area (excluding garages, decks, porches). Exteriors must be completed within 12 months of starting construction.
- Assessments & fees: Annual assessments are set by the HOA and can increase up to 10% per year without a vote; larger increases require a 2/3 vote of each membership class. Special assessments for capital improvements need a majority vote. A non-refundable working capital assessment equal to at least two months' estimated common expenses is due at closing. Assessments are collected quarterly.
- Membership & voting: Each lot owner is a member of the HOA. There are four voting classes: Class A (Lots 2 & 3, one vote each), Class B (Lot 4, one vote), Class C (Declarant, three votes per lot owned, converting by Dec 31, 2005 or when other votes equal Class C), and Class D (Lot 1, if included, one vote). No more than one vote per lot.
- Easements & access: The HOA and Declarant have easements for utilities, drainage, and emergency access. The Declarant may install street lighting and cut trees or grade for utility installation. Owners have access and utility easements as shown on the recorded plat.
- Penalties & liens: Unpaid assessments accrue interest at the maximum legal rate and become a lien on the lot. The HOA can sue the owner personally or foreclose the lien. Penalty assessments for rule violations are treated the same way. The assessment lien is subordinate to first mortgages.
- Insurance & fidelity bonds: The HOA must carry property, liability, and directors' liability insurance, and maintain fidelity bonds for all officers and employees handling funds (minimum three months' aggregate assessments plus reserves). Insurance premiums are a common expense assessed to all owners.
