Woodlake at Lord's Creek is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). These covenants, conditions, and restrictions (CC&Rs) apply to all lot owners and residents, setting rules for residential use, construction, maintenance, and community standards.
- Lot use & construction: Lots are for single-family residential use only. Homes must have at least 1,800 heated square feet, a two-car garage, and be built on a crawl space. No mobile homes, modular homes, or manufactured housing are allowed. All construction requires approval from the Architectural Control Committee (ARC), and a $1,000 deposit is required for trash cleanup and road repair.
- Architectural review: The ARC must approve all building designs, exterior colors, landscaping plans, fences, and satellite dish locations. Fences cannot be chain link, split rail, or welded wire. White window treatments visible from the street are required within 10 days of occupancy.
- Maintenance & nuisances: Lot owners must keep their property neat and free of debris, mow grass shorter than 8 inches, and remove tree limbs up to 6 feet. No statues, yard decorations, or artificial wildlife are allowed. The HOA may perform maintenance and charge the owner plus a 20% service fee.
- Parking & vehicles: Vehicles must be parked in driveways, not on lawns or common areas. No overnight parking on roadways. Inoperable vehicles, tractor-trailers, and boats/RVs are prohibited unless stored in an enclosed garage. Vehicle repairs must be completed in one day.
- Pets: Only domesticated household pets are allowed, not for breeding or commercial purposes. Prohibited breeds include Rottweilers, Presa Canarios, Dobermans, Chow-Chows, Pit Bull breeds, and Wolf Hybrids. Pets must be leashed on common areas, and owners must clean up waste. The HOA can require removal of a pet that violates rules.
- Assessments & fees: All lot owners must pay annual assessments, special assessments (approved by 2/3 vote), and a nonrefundable working capital assessment equal to three months of annual assessment. Assessments can be increased up to 25% per year by the Board, or more with a 2/3 vote. Delinquent assessments accrue interest and can become a lien on the property.
- Stormwater management: Each lot has a maximum built-upon area (3,200 sq ft for lots 1-180, 3,700 sq ft for lots 181-246). Runoff must drain into the permitted system. The HOA maintains ponds and the stormwater system.
