Island Breeze Townhomes is a small townhome community in Wilmington, NC, governed by a homeowners association. This document is the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that applies to all owners, residents, and guests. - What you own & maintain: You own your individual townhome unit (lot) and an undivided interest in the common elements. The association maintains common areas, drainage, streets, and entrances. Each unit owner is responsible for maintaining their own unit and any assigned limited common elements (e.g., an elevator).
- Leasing & rentals: Units may be used for residential rental purposes, but no single rooms may be rented. Leases must be for a term of at least six months.

- Common elements & amenities: Common elements include areas outside the units. The swimming pool is exclusively owned by Unit 2 and conveys with that unit. Each unit has an assigned elevator as limited common area, maintained by the unit owner.
- Assessments & fees: The association levies assessments to cover common expenses. Unpaid assessments create a lien on the unit. The declarant (developer) is exempt from assessments on unsold lots.
- Insurance: Each unit owner must maintain insurance covering fire/hazard, wind, hail, and flood (if required). Proof of insurance must be provided to the association.
- Enforcement & violations: The association or any owner may enforce the rules. The association can suspend voting rights and use of facilities for unpaid assessments (until paid) or for up to 60 days for rule infractions.
