What Lamb's Bluff's governing documents say
Lamb's Bluff is a single-family residential subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1994. These rules apply only to Section 1 of the subdivision and are enforced by the Lamb's Bluff Homeowners Association, with additional membership in the Tidewater Plantation Association for common areas. Every lot owner automatically becomes a member of both associations and must pay assessments.
- Use restrictions: All lots are for single-family residential use only. No commercial activity, noxious trade, or nuisance is allowed. Temporary structures, trailers, mobile homes, tents, and garage apartments cannot be used as living quarters.
- Building & setback requirements: Minimum dwelling size is 1,700 sq ft with an attached garage (or 1,850 sq ft without garage), measured by exterior foundation excluding porches, steps, garages, etc. Front setback is 45 feet (35 feet for cul-de-sac lots), side setback is 5 feet, and at least 10 feet between structures. Corner lots use the side with least frontage as the front.
- Architectural review: Building plans must be approved by the Developer (or successor). If no response within 20 days of submission, plans are deemed approved as long as they are in general conformity with other improvements in the subdivision.
- Pets: Only domesticated dogs, cats, or other household pets are allowed. They cannot be kept for commercial purposes or in numbers that become a nuisance.
- Vehicles & storage: Boats, recreational vehicles, travel trailers, and utility trailers must be stored in a garage or screened area not visible from the front or rear of any lot. Inoperative junk cars and eyesores are prohibited and may be removed at the owner's expense.
- Fences & signs: Fences cannot exceed 6 feet in height and must be wood or chain-link, located no closer to the front street line than the rear corners of the house. Decorative fencing (split-rail, brick, wrought-iron) up to 4 feet may be allowed with Developer's written consent. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 6 square feet.
- Assessments & liens: The Association levies annual and special assessments. Annual assessments can be increased up to 20% per year by the Board; higher increases require a 51% member vote. Special assessments for capital improvements also require a 51% vote. Unpaid assessments bear 12% annual interest and become a lien on the lot, enforceable by foreclosure.
- What this document doesn't cover: This document does not specify the amount of assessments, the existence or details of amenities (pool, clubhouse, etc.), or the full bylaws of the Association. It also does not address age restrictions, rental limits, or parking rules beyond vehicle storage.
