Bella Port is a planned single-family home community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions that apply to all lot owners and occupants.
- What you own & maintain: You own your lot and the single-family home on it, and you are responsible for all maintenance of the dwelling, driveway, walkways, landscaping, and exterior elements. The HOA maintains the common areas (like roads and open space) and certain landscape buffer areas.
- Architectural review: Any exterior changes—including paint, landscaping, fences, or structures—must be approved in writing by the HOA's Reviewing Authority. Plans must be submitted showing design, materials, and location. Temporary seasonal decorations are exempt, but can be ordered removed if deemed distasteful.
- Residential use & home businesses: Lots are for single-family residential use only. Home businesses are allowed only if operated by a resident, have no outside signs or customer traffic, no on-site employees except household members, and require annual HOA approval.
- Minimum home size: The primary dwelling must have at least 2,500 square feet of enclosed, heated/cooled floor area (excluding garages, porches, decks). A two-car attached garage is required. The HOA may grant variances up to 15%.
- Parking & vehicles: Parking is allowed only in garages or driveways; a maximum of two vehicles may be parked outside the garage. Commercial vehicles, boats, trailers, RVs, and inoperable vehicles are prohibited unless fully enclosed in a garage. Garage doors must stay closed except when entering or exiting.
- Leasing & rentals: Lots may be leased for residential purposes. Owners must require tenants to follow all HOA rules. The HOA can evict tenants for noncompliance and assess costs to the owner. Accessory dwelling units (e.g., studio above garage) cannot be leased separately unless as part of employee compensation.
- Pets: Only common household pets (dogs, cats) are allowed, and they must be leashed and under control when outside. No commercial breeding. The HOA may set limits on number and size of pets.
- Assessments & fees: Annual assessments start at $700 per lot (projected maximum) and can increase up to 15% per year without member vote. A one-time working capital fee of $400 is due at closing. Special assessments require a 2/3 member vote. Unpaid assessments become a lien on the lot.
